EPA Delays Enforcement of Lead Rule
(Jun.
18) The Environmental Protection Agency acknowledged the need for additional
time for renovation firms and workers to become trained and certified under the
new Lead Renovation, Repair and Painting (RRP) Rule.
The rule took effect
April 22, but the EPA
announced it was delaying enforcement, acknowledging concerns raised by the
NLBMDA, its building industry allies and its supporters in Congress.
The
specific delays are:
- Until Oct. 1, 2010, the EPA will not take
enforcement action for violations of the RRP Rule's firm certification requirement.
- For
violations of the RRP Rule's renovation worker certification requirement, the
EPA will not enforce against individual renovation workers if the person has applied
to enroll in, or has enrolled in, by no later than Sept. 30, 2010, a certified
renovator class to train contractors in practices necessary for compliance with
the final rules. Renovators must complete the training by Dec. 31, 2010.
Despite
the delay in enforcement, the NLBMDA said it continues to have numerous concerns
with the RRP Rule, including the removal of the opt-out provision and the lack
of reliable test kits. In addition, new proposals from the EPA on clearance testing
and an expansion of the rule to commercial construction pose additional challenges
for the industry, which has still yet to recover from the recession.
The
NLBMDA
said it will continue to seek ways to mitigate the impact of the rule on the industry. |

Retail & Contractor Sales Now in One Location (Effective
March 1)

retail and contractor sales into one location effective March 1st. All transactions
will now be done at the sales counter located in the back of the store. The flooring
department will remain in its current location at the front of the store. |
| The EPA Renovate, Repair & Painting Rule Goes Into
Effect on April 22, 2010
The law, 40 CFR Part 745, requires that any renovations
performed for conpensation on homes built before 1978, must be done by EPA certified
firms using certified renovators. In addition to contractors, this includes landlords
and property managers. The fines for non compliance are up to $37,500 per violation.
Fines can be assessed up to 3 years after the completion of the project.
